Mastering Conflict: How Mediation Can Lead to Victory
Download MP3So, in addition to doing investigations, we are also a licensed civil court mediator. So if you're in a conflict with another party, a lot of times mediation can be helpful to resolve that issue. Sometimes, you might want to negotiate a settlement with attorneys, but attorneys aren't necessarily mediators, or they're not necessarily counselors. What they're trying to do is just fight for you against the other party, and you don't necessarily want to fight; you want to have a resolution. Speakers there are from all over the country that do many different things in terms of helping disputants—people that are in a dispute—resolve their differences. Whether or not you have a fraud case, a divorce case, or an embezzlement case, even if you don't directly do mediation with the other person, if you have a mediator counsel you on how to negotiate, how to present things to the other person, many times you can take away the sticking points. Most of the time, deals fail on principle. The other side looks at you and says, "I'm not doing it no matter what. I'm holding my breath until I turn blue." There are many very clever little things you can do in your communications to help manipulate the process and get the results that you want.
